Distance Selling Agreement
ARTICLE 1 – PARTIES
1.1 – SELLER Title:
ysrastore / ysrastore.com / support@ysrastore.com
1.2 – BUYER
The person who registers as a customer on the ysrastore.com shopping site.
The address and contact information used during registration will be considered the basis.
ARTICLE 2 – SUBJECT
The subject of this agreement is the sale and delivery of the product, whose characteristics and sales price are specified below, which the BUYER ordered electronically from the ysrastore.com website belonging to the SELLER, and the determination of the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on the Principles and Procedures of Distance Contracts.
ARTICLE 3 – SUBJECT OF THE AGREEMENT
The type, quantity, brand/model, color, number of units, sales price, payment method, and information at the time of order completion of the goods/product/service constitute the subject of this agreement.
ARTICLE 4 – GENERAL PROVISIONS
4.1 The BUYER declares that they have read and are aware of the preliminary information regarding the essential characteristics of the product subject to this agreement, the sales price including all taxes, the payment method, delivery and the fact that the delivery costs will be borne by the BUYER, the delivery period, and the full commercial name, address, and contact information of the SELLER on the ysrastore.com website, and that they have provided the necessary confirmation electronically.
By confirming this agreement electronically, the BUYER confirms that they have received accurate and complete information from the Seller regarding the address, the essential characteristics of the ordered products, the price of the products including taxes, and payment and delivery information, which must be provided to the Consumer before the conclusion of distance contracts.
4.2 The product subject to this contract will be delivered to the BUYER or the person/entity at the address indicated, within the time frame specified in the preliminary information on the website, depending on the distance of the BUYER's place of residence for each product, provided that the legal 30-day period is not exceeded.
4.3 If the product subject to this contract is to be delivered to a person/entity other than the BUYER, the SELLER cannot be held responsible if the recipient refuses delivery.
4.4 The SELLER cannot be held responsible for the failure to deliver the ordered product to the BUYER due to any problems encountered by the shipping company during the delivery process.
4.6 The SELLER may, provided there is a justifiable reason, supply the BUYER with a different product of equal quality and price before the expiration of the performance obligation arising from this contract.
4.7 If the SELLER is unable to fulfill its contractual obligations due to the impossibility of delivering the ordered product or service, it shall notify the consumer of this situation before the expiration of the performance period arising from the contract and may supply the BUYER with a different product of equal quality and price.
4.8 Delivery of the product subject to this contract is conditional upon the signed copy of this contract being delivered to the SELLER and the payment being made using the payment method preferred by the BUYER.
4.9 The BUYER acknowledges and undertakes that the credit card information entered into the system during the purchase is correct and that all legal and criminal responsibility arising from the use of this credit card rests with them.
4.10 If the SELLER is unable to deliver the product subject to this contract within the specified time due to force majeure or extraordinary circumstances preventing transportation, it is obliged to inform the BUYER of the situation.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The buyer has the right to return the product once it has been delivered to the buyer or the person/entity at the address indicated, provided that the product box/contents are opened and the condition is such that it prevents resale.
ARTICLE 6 – PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED
Due to their nature, single-use products, damaged or used products, and products that spoil quickly or are likely to expire are not eligible for return.
ARTICLE 7 – DEFAULT BY THE DEBTOR
In the event of default by the BUYER, the BUYER agrees to compensate the SELLER for any loss or damage incurred due to the delayed performance of the obligation.
